Community Wildfire Prevention Grant Program

Terms & Conditions

These Terms & Conditions apply to a program in which The Wawanesa Mutual Insurance Company (“Wawanesa”) intends to provide selected eligible applicants with grants for the purpose of mitigating or preventing wildfire damage in communities (the “Community Wildfire Prevention Grant Program”). In these Terms & Conditions, any reference to: (a) “Applicant” refers to and includes any organization or entity applying for a grant pursuant to the Community Wildfire Prevention Grant Program, regardless of whether such organization or entity is successful in receiving a grant; and (b) “Recipient” refers to and includes any organization or entity that is selected to receive a grant under the Community Wildfire Prevention Grant Program.

By applying for a grant under the Community Wildfire Prevention Grant Program, all Applicants confirm that they are fully aware of and accept all of these Terms & Conditions:

  1. The submission of an application pursuant to the Community Wildfire Prevention Grant Program does not entitle Applicants to grant funding. Applicants acknowledges that the Community Wildfire Prevention Grant Program may be terminated, suspended or modified at any time.
  2. The administration of the Community Wildfire Prevention Grant Program, including the review of applications, assessment of Applicants, selection of Recipients and the distribution of all grant funds, shall be in the sole and absolute discretion of Wawanesa. Without limiting the foregoing, Wawanesa, in its sole and absolute discretion, may reject any application that is ineligible, inaccurate or incomplete.
  3. Applicants shall not be entitled to recover any costs of submitting an application in relation to the Community Wildfire Prevention Grant Program.
  4. The administration of the Community Wildfire Prevention Grant Program, including the application process thereunder, is subject to Wawanesa’s applicable policies.
  5. All Recipients of grant funding under the Community Wildfire Prevention Grant Program must comply with and ensure their funded projects are in compliance with all applicable laws, including obtaining all required permits and authorizations required by any governmental authority or other entity having jurisdiction.
  6. Recipients shall use the grant funds in good faith and in the manner set forth in their application for the grant funding under the Community Wildfire Prevention Grant Program.
  7. Upon request, Applicants shall immediately refund to Wawanesa any payment received under the Community Wildfire Prevention Grant Program if the Applicant is in material breach of any of these Terms & Conditions.
  8. Applicants shall not use any grant funds received pursuant to the Community Wildfire Prevention Grant Program for any purpose other than the project set forth in the Applicant’s application. Applicants shall not use any grant funds received pursuant to the Community Wildfire Prevention Grant Program to reimburse any expenses incurred by the Applicant prior to the date the grant funding is provided to the Applicant under the Wildfire Grant Program.
  9. Applicants may not assign, or transfer by operation of law or court order, any of their rights or obligations in respect of an application under the Community Wildfire Prevention Grant Program without the prior written approval of Wawanesa.
  10. Each Applicant represents and warrants that:
    1. the person signing the application on behalf of the Applicant is duly authorized to make the application and bind the Applicant to these Community Wildfire Prevention Grant Program Terms & Conditions;
    2. no additional or other application for funding has been made for the same activities or project contemplated in the Applicant’s application; and
    3. the Applicant is in compliance with all laws, orders and authorizations which relate to or affect it and the Applicant is not subject to any order of any court or other tribunal affecting its operations.
  11. Applicants shall not use or permit the use of the name, logo or any trademarks of Wawanesa (or any of its affiliates) or any of its contractors or agents involved with the Community Wildfire Prevention Grant Program, except with the express prior written consent of Wawanesa or its affiliate, contractor or agent, as applicable. No press release or other publicity (including social media) regarding a project funded under the Community Wildfire Prevention Grant Program may name or identify Wawanesa (or any of its affiliates) or any of its contractors or agents involved with the Community Wildfire Prevention Grant Program, except with the express prior written consent of Wawanesa or its affiliate, contractor or agent, as applicable.
  12. Recipients may be required to sign Wawanesa’s form of Acknowledgement and Waiver prior to grant funds being provided to Recipients.
  13. LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE WAWANESA MUTUAL INSURANCE COMPANY (OR ANY OF ITS AFFILIATES, AGENTS, OR CONTRACTORS, OR ANY OF ANY OF THEIR EMPLOYEES, OFFICERS OR DIRECTORS) HAVE ANY LIABILITY FOR ANY LOSSES, DAMAGES OR CLAIMS WHATSOEVER, INCLUDING ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, HOWSOEVER CAUSED, WHETHER IN TORT, CONTRACT, OR OTHERWISE, ARISING DIRECTLY OR INDIRECTLY OUT OF OR RELATED TO THE COMMUNITY WILDFIRE PREVENTION GRANT PROGRAM, INCLUDING ANY ONE OR MORE OF THE ADMINISTRATION OF THE GRANT PROGRAM OR THE EXECUTION, CONSTRUCTION, OPERATION, USE OR RESULTING EFFECT OF ANY PROJECT IN RESPECT OF WHICH GRANT FUNDS WERE USED, EVEN IF ANY OF THE PARTIES ENTITLED TO THE BENEFIT OF THIS LIMITATION OF LIABILTY HAVE BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH LOSS, DAMAGE OR CLAIM.
